    1. What these terms cover. These are the terms and conditions for the sale of Assessment Units by CPD partners and schools via the Chartered College Shop.
    2. Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how to order, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
  2. Information about us and how to contact us
    1. Who we are. We are The Chartered College of Teaching a charity incorporated by the Royal Charter with number RC000128. Our address is Pears Pavilion, Coram Campus, 41 Brunswick Square. London WC1N 1AZ. Our registered VAT number GB 310956417.
    2. How to contact us. You can contact us by telephoning our customer service team at 0118 370 1709 or by writing to us at charteredteacher@chartered.college or Chartered College of Teaching, Pears Pavilion, Coram Campus, 41 Brunswick Square, London, WC1N 1AZ.
    3. How we may contact you. If we have to contact you regarding your order, we will do so by telephone or by writing to you at the email address or postal address you provided to us during your registration as a Learning Partner or the contact details linked to your membership profile.
    4. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
  3. Our contract with you
    1. How we will accept your order. Subject to eligibility requirements (being a school administrator and/or a member of the Chartered College of Teaching) once you purchase Assessment Unit vouchers via the Chartered College Shop and payment has been made the screen will confirm the purchase.
    2. If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because our services are limited or out of stock, there was an issue with your registration or you don’t fit the criteria required, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
    3. We sell to the UK and worldwide. Our Assessment Unit sales are open to all Learning Partners and members of the Chartered College of Teaching worldwide, subject to meeting the necessary eligibility requirements and paying the required fees. All fees are payable in British Pound.
    4. Process. In order to make the Assessment Unit purchase please follow the below process;

    1. The Products. Details of our products can be found in the Product Overview.
    2. Digital Access. Each assessment unit includes full guidance documents for the relevant assessments and examinations and a range of core content/guides which may include audio, visual and written formats. You will have access to each assessment unit for a period of 18 months.
  2. Our rights to make changes
    1. Minor changes to the products. We may change the products:
      1. to reflect changes in relevant laws and regulatory requirements; and
      2. to implement minor technical adjustments and improvements, for example to address a security threat. These changes will not affect your use of the
  1. Providing the products and limitation of use
    1. When we will provide the products. The vouchers are redeemable as soon as the vouchers are purchased and the code received via email.
    2. Expiry of voucher codes. The voucher codes are valid for three months from date of purchase. At the end of the three months expiry period additional voucher codes will need to be purchased via the same process as per 3.4.
    3. Transfer of vouchers is not allowed. Once the voucher codes are purchased, the codes can not be transferred to a different candidate.
    4. Vouchers are non-refundable. Once the voucher codes are purchased, there is no cooling off period in this instance. All individuals are required to be sure of their purchase and its use. This does not affect your statutory rights.
    5. Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most services bought online you have a legal right to change your mind within 14 days and receive a refund. This is known as the cooling period. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms.
    6. When you don’t have the right to change your mind. You do not have a right to change your mind in respect of:
      • digital products after you have accessed the unit content;
      • services, once these have been completed, even if the cancellation period is still running;
      • sealed audio or sealed video recordings or sealed computer software, once these products are unsealed after you receive them.
  1. Data Retention Policy
    1. How we will use your personal details when purchasing. We will use  individuals personal and contact details for our internal record purposes. By agreeing our terms, you are agreeing to permit us to retain the information for the duration that you are a member of the Chartered College of Teachers. Please refer to our Data Retention Policy for more details.

  1. Intellectual Property Rights
    1. How we may use your personal information. We will only use your personal information as set out in our Privacy Policy, which can be found at chartered.college/privacy-policy. We will supply the assessments to you and process payment for the assessments, and contact you with any supporting content or opportunities that will support you to work towards Chartered Teacher Status. You can stop receiving this information at any time by contacting us.
    2. All registered members who sit the assessment will consent and agree that the Chartered College of Teaching will use part of the assessment material for fair dealing for purposes of illustration for instruction, pursuant to Copyrights Design and Patents Act 1988 ‘CDPA’.
  2. How we may use your personal information
    1. Your personal information will only be given to third parties where you have provided consent for us to do so. We will also use your information if the law requires or allows us to do so.
  3. Our rights to end the contract
    1. We may refuse purchase of voucher codes. We may reject the purchase of voucher codes at any time if:
      • you do not make any payment of previous purchase of voucher code to us when it is due and you still do not make payment within 30 days of us reminding you that payment is due;
      • you are no longer a member of the Chartered College or a registered Learning Partner;
      • if you fail to provide us with a change of circumstances within 28 days. For example, your qualification status regarding any disciplinaries or misconduct at place of work.
      • you behave in a way that is inappropriate, unethical or could cause damage or loss to us, our staff or other candidates as determined by one of our senior leadership team;

  1. Price and payment
    1. Where to find the price for the product. The price of the voucher codes (which includes VAT) will be the price indicated at the point of purchase. We will not provide any reduction, compensation or payment of any travel, accommodation or other expenses. We take all reasonable care to ensure that the price of the assessment advised to you is correct. There is no VAT payable as this product is exempt from VAT
    2. What happens if we got the price wrong. It is always possible that, despite our best efforts, some Chartered Status assessment units may be incorrectly priced.
    3. When you must pay and how you must pay.
      • Voucher codes are paid upon ordering.
      • If payment is paid following an issue of an invoice discount may be applied before the invoice is issued. This applies only if the discount is previously agreed with the Chartered College of Teachers.
      • If payment is paid by card, no discount will be applied or can be applied in future to the same transaction.
      • All invoices must be paid within 14 days of issue. If the invoice is not paid within 14 days, as requested there will be an interest of 8% per annum added until payment is paid in full.
      • All resubmission as a result of a fail to the assessment unit purchased will require a further purchase by the candidate and/or the Learning Partner on their behalf.
    4. What to do if you think an invoice is wrong. If you think an invoice is wrong please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved we will charge you interest on correctly invoiced sums from the original due date.
  2. Our responsibility for loss or damage suffered by you
    1. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We are not liable for any loss or damage, as a result of third party failures or negligence.
  3. Other important terms
    1. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the terms.
    2. You can’t transfer your purchases to someone else (except that you can always transfer our guarantee). You can’t transfer your voucher codes to anyone else other than to the person’s email you have provided at the time of purchase and order confirmation.
    3. Nobody else has any rights under this terms. These terms and conditions are between you and us. No other person shall have any right to enforce any of its terms.
    4. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    5. Even if we delay in enforcing these terms, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these terms and conditions, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.
    6. The Courts in England and Wales shall have the exclusive rights to settle any dispute or claim arising out of or in connection with these terms and conditions or its subject matter or formation including non-contractual disputes or claims.
    7. How we deal with disputes. If a dispute arises out of or in connection with these terms and conditions (Dispute), either party shall give to the other written notice of the Dispute, setting out its nature and full particulars (Dispute Notice), together with relevant supporting documents. We shall attempt in good faith to resolve the Dispute. If we are for any reason unable to resolve the Dispute within 30 days of service of the Dispute Notice, we agree to enter into mediation in good faith to settle the Dispute in accordance with the CEDR Model Mediation Procedure. Unless otherwise agreed between us within ten (10) days of service of the Dispute Notice, the mediator shall be nominated by CEDR. The commencement of mediation shall not prevent you or us from commencing or continuing court proceedings in relation to the Dispute under clause 15.6, which shall apply at all times.
